1. Acceptance of Terms

Welcome to Heurys. These Terms of Service ("Terms") are a legally binding agreement between you ("you" or "User") and Heurys, LLC ("Heurys," "we," "us," or "our"), a limited liability company organized under the laws of the State of Delaware, United States.

By accessing or using the Heurys website at heurys.com and the Heurys domain security platform (collectively, the "Service"), you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and "you" refers to both you individually and that organization.

2. Description of Service

Heurys is a domain security SaaS platform that provides:

• Domain security scanning and analysis (SPF, DKIM, DMARC, DNSSEC, SSL/TLS, MTA-STS, and more)
• Continuous domain monitoring with automated alerts
• Security scoring and grading for domain configurations
• Actionable recommendations to improve domain security posture
• Historical scan data and trend tracking
• Reporting and compliance documentation

The Service scans publicly available DNS records and configurations. We do not access private networks, internal systems, or non-public data as part of the scanning process.

3. Account Registration

To access certain features of the Service, you must register for an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security and confidentiality of your login credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

You must be at least 16 years of age to create an account. We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe to be fraudulent.

4. Subscription & Billing

Plans and Pricing

Heurys offers both free and paid subscription plans. Features, limits, and pricing for each plan are described on our Pricing page. We reserve the right to modify pricing with 30 days' advance notice.

Payment Processing

All payments are processed securely through Stripe. By subscribing to a paid plan, you authorize us to charge the payment method on file for the applicable subscription fees. All fees are stated in US Dollars unless otherwise specified.

Billing Cycle

Paid subscriptions are billed in advance on a monthly or annual basis, depending on the plan you select. Your subscription will automatically renew at the end of each billing cycle unless you cancel before the renewal date.

Refunds

We offer a 14-day money-back guarantee for new paid subscriptions. If you are not satisfied with the Service, you may request a full refund within 14 days of your initial purchase. After this period, subscription fees are non-refundable. Refunds for annual plans after the 14-day period will be handled on a case-by-case basis.

Failed Payments

If a payment fails, we will attempt to charge your payment method again and notify you via email. If payment remains unsuccessful after multiple attempts, we may downgrade your account to the free plan or suspend your access to paid features.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party rights
• Scan domains you do not own or are not authorized to scan in a manner that constitutes unauthorized access
• Attempt to gain unauthorized access to the Service, other users' accounts, or our systems and networks
• Use the Service to launch attacks, exploit vulnerabilities, or engage in any malicious activity against third parties
• Interfere with or disrupt the integrity or performance of the Service or its underlying infrastructure
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service
• Use automated scripts, bots, or scrapers to access the Service beyond the rate limits of your plan
• Resell, sublicense, or redistribute the Service without our written consent
• Use the Service to collect or store personal data about other individuals without their consent

We reserve the right to investigate and take appropriate action against anyone who violates this section, including suspending or terminating their account and reporting such conduct to law enforcement.

6. Intellectual Property

Our Intellectual Property

The Service, including its original content (excluding content provided by users), features, functionality, design, logos, trademarks, and software, is and will remain the exclusive property of Heurys, LLC. The Service is protected by copyright, trademark, and other laws of the United States and foreign countries.

Your Content

You retain ownership of any content you submit to the Service (such as domain configurations or custom settings). By submitting content, you grant us a limited, non-exclusive, royalty-free license to use, process, and display that content solely as necessary to provide the Service to you.

Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, non-exclusive, royalty-free license to use, modify, and incorporate such feedback into the Service without any obligation to you.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HEURYS, LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

• Your access to or use of (or inability to access or use) the Service
• Any conduct or content of any third party on the Service
• Unauthorized access, use, or alteration of your transmissions or content
• Any errors, inaccuracies, or omissions in the scan results or security recommendations provided by the Service

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED US DOLLARS ($100), WHICHEVER IS GREATER.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Heurys does not warrant that the Service will be uninterrupted, timely, secure, or error-free. Scan results and security grades are informational tools and should not be considered a guarantee of security. You are solely responsible for implementing security measures for your domains and systems.

9. Indemnification

You agree to defend, indemnify, and hold harmless Heurys, LLC and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property rights; or (d) any content you submit through the Service.

10. Termination

You may terminate your account at any time by contacting us or through your account settings. Upon termination:

• Your right to access the Service will cease immediately
• Any remaining subscription period is non-refundable (except within the 14-day guarantee period)
• We will retain your data for up to 30 days to allow for account recovery, after which it will be deleted in accordance with our Privacy Policy

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Grounds for termination include, but are not limited to, violation of these Terms, non-payment, fraudulent activity, or conduct harmful to other users or the Service.

11. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved informally within 30 days, either party may initiate binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.

You agree that any arbitration or legal proceeding shall be conducted on an individual basis and not as a class action or other representative proceeding. The arbitration shall take place in the State of Delaware, and the language of the arbitration shall be English.

12. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

13. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

• Update the "Last updated" date at the top of this page
• Notify you via email at least 30 days before the changes take effect
• Post a prominent notice on the Service

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service and terminate your account.
